Terms of Service

The terms that govern access to and use of FiveMesh services.

Introduction

These Terms of Service ("Terms") govern your access to and use of the FiveMesh website, dashboard, APIs and infrastructure services. FiveMesh is powered by sCloud.

By creating an account, accessing the dashboard or using the services, you agree to these Terms. If you do not agree, you must not use FiveMesh.

Eligibility and Authority

You must be able to enter into a binding agreement to use FiveMesh. If you use FiveMesh on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Use of the Services

FiveMesh provides infrastructure tools for FiveM communities, including CDN, Cache, storage, dashboard, API and related platform features. You agree to use the services only for lawful purposes and in accordance with these Terms, the Acceptable Use Policy and applicable documentation.

  • Do not attempt to disrupt, compromise or bypass FiveMesh systems.
  • Do not use the services in ways that violate laws or third-party rights.
  • Follow service limits, fair-use rules, rate limits and technical requirements.
  • Keep your configurations, uploaded content and integrations compliant with applicable law.

Accounts and Security

  • You are responsible for keeping credentials, sessions and API keys secure.
  • You are responsible for activity under your account, organizations and API keys.
  • You must provide accurate account and billing information.
  • You must notify us promptly if you suspect unauthorized access or security issues.

Payments and Merchant of Record

FiveMesh uses Polar as payments platform and Merchant of Record. When you purchase or subscribe to paid FiveMesh services, checkout, billing, invoicing, receipts, tax calculation and payment collection may be handled by Polar.

Polar or its affiliates may appear as the seller on your invoice, receipt, checkout page or bank statement. FiveMesh remains responsible for delivering and supporting the FiveMesh service.

Subscriptions, Trials and Refunds

Paid subscriptions renew automatically unless cancelled before the renewal date. You can manage or cancel your subscription from your account where supported.

Starter may include a 14-day free trial. Paid subscriptions include a 14-day money-back guarantee, subject to abuse prevention, payment processor rules and mandatory rights that apply in your jurisdiction.

If a payment fails, is reversed, is disputed or cannot be processed, access to paid features may be suspended or limited until the issue is resolved.

Taxes and Invoices

Polar calculates, collects and remits applicable taxes, including VAT or GST where required. Invoices and receipts are issued by Polar as Merchant of Record and may be used for tax purposes where applicable.

Disputes and Chargebacks

If you believe a charge is incorrect, contact us first so we can help investigate. Disputes, refunds and chargebacks may be processed through Polar according to its procedures.

We may suspend or restrict access for unresolved, abusive or fraudulent payment activity.

Availability and Changes

We work to keep FiveMesh reliable, but the services may be interrupted by maintenance, incidents, provider outages, security actions or changes to features.

We may modify, add or remove features, limits, plans or integrations over time. Where practical, we will communicate material changes that affect active customers.

Third-Party Services

FiveMesh may rely on third-party providers for hosting, payments, authentication, security, monitoring, email, analytics and support. Your use of certain features may also be subject to third-party terms or policies.

Intellectual Property

FiveMesh, sCloud, related software, branding, design, documentation and platform materials are owned by us or our licensors and are protected by intellectual property laws.

You retain ownership of content you upload or configure through the services. You grant us a limited license to host, cache, process, transmit, display and otherwise handle that content only as needed to provide, secure and support the services.

Acceptable Use and Suspension

You must comply with the Acceptable Use Policy. We may suspend, restrict or terminate access if you breach these Terms, create risk for the platform, violate law, fail to pay, or use the services in a way that harms FiveMesh, other users or third parties.

Disclaimers

To the maximum extent permitted by law, FiveMesh is provided "as is" and "as available" without warranties that the services will be uninterrupted, error-free or suitable for every specific use case.

Nothing in these Terms limits statutory rights that cannot be limited under applicable law.

Limitation of Liability

To the maximum extent permitted by law, FiveMesh, sCloud and their providers are not liable for indirect, incidental, special, consequential, punitive or exemplary damages, or for loss of profits, revenue, data, goodwill or use arising from or related to the services.

Governing Law

These Terms are governed by the laws of Belgium and applicable EU law, without regard to conflict-of-law rules. Courts located in Belgium have exclusive jurisdiction unless mandatory law requires otherwise.
